SUNPROFIT® REWARDS TERMS & CONDITIONS
Thank you for submitting this referral. As a member of Solar Liberty’s SunProfit® Referral Program (a “Referrer”), you are subject to Solar Liberty’s Terms and Conditions and Solar Liberty’s Privacy Policy as well as to the additional terms set forth in these SunProfit® Referral Program. Please note that, unless we define a term in these SunProfit Referral Program Terms, all capitalized terms used herein have the same meanings as in our Terms and Conditions.
Becoming a Referrer. Any individual who is otherwise eligible to participate may become a member of Solar Liberty’s SunProfit Referral Program by submitting the name, address, telephone number and email of a friend that you believe would be interested in purchasing a photovoltaic system (“Referred Prospect”).
Qualified Referral. A Referred Prospect becomes a Qualified Referral upon the occurrence of all of the following purchase made by a person (i) whose contact information is provided to Solar Liberty by you (a “Referred Customer“) under the SunProfit Referral Program, (ii) is a first-time Purchaser of Products; (iii) for services in the state of New York; and (iv) by a purchaser located in the United States; not otherwise know to Solar Liberty or referred by another third party before your referral. All determinations of whether a referral qualifies as Referred Customer shall be made in Solar Liberty’s sole and exclusive determination.
Single Household. The Referred Customer and the Referrer cannot reside in the same household as or be the same person (for example, by using a different email address), as determined in Solar Liberty’s sole and exclusive discretion.
Cash Reward for Appointment. You will receive a cash award of $25.00 US for a Qualified Referral that requests a residential proposal for a solar installation, attends a sales meeting in the State of New York, and considers the proposal in good faith. You will receive a cash award of $50.00 for a Qualified Referral that requested Solar Liberty to conduct a commercial proposal for a solar installation attends a sales meeting in the State of New York and considers the proposal in good faith. The cash award is payable regardless of whether the Qualified Referral makes a purchase.
Cash Reward for Qualifying Purchases. You will receive a cash award of $250.00 when a Qualified Referral that you provide signs and completes a contract with Solar Liberty for the purchase of at least 3kW of solar energy or one lithium-ion battery system for a private residence within the State of New York; or you will receive a cash award of $500.00 when a Qualified Referral that that you provide signs and completes a contract with Solar Liberty to purchase at least 25kW of products and services for a commercial entity in the State of New York from Solar Liberty (collectively “Qualified Purchases”).
Award of SUNPOINTS™. A “SUN” or “SUNs,” as used in these terms and conditions is defined as a unit of awarded points that Solar Liberty gives to you to redeem gifts and prizes when a Qualified Referral that you provide makes a Qualified Purchase. Every Qualified Purchase goods and services for residential photovoltaic systems and other amenities provided by Solar Liberty will result in your being awarded one SUN points or one SUN. Every Qualified Purchase of goods and services for commercial products and services provided by Solar Liberty will result in your being awarded at least two SUN points or two SUNs. Solar Liberty may award additional SUNs to you if your Qualified Referral results in large system sizes according to the following Chart
SUNS can be redeemed anytime you choose. Collecting or combining SUNs is expressly. The SUNs are redeemable for gifts only. There is no cash value for a SUN. If a SUN is not redeemed after ten (10) years without any activity from the time we award you SUNPOINTS, Solar Liberty may in our sole discretion, consider your points abandoned, redeem them for you with a gift of our choosing, and close-out your accumulated SUN points.
Eligibility. Solar Liberty’s SunProfit Referral Program cannot be used by individuals and businesses that provide lead generation, commercial referral services or other marketing services in addition to the terms agreed upon between Solar Liberty and their marketing service. Participants may be disqualified if they have any contract or agreement with Solar Liberty, if Solar Liberty deems the contract subject matter already covers the scope of the person’s activities. For example, sales agents that have other compensation agreements may not benefit under both its compensation agreement. Any party that has a contract or agreement with Solar Liberty may be disqualified from participating if Solar Liberty, upon reasonable review deems in its sole discretion that such contracting party should not qualify as a program participant.
No Combination. Referred Customers may not combine any discounts obtained through their use of the SunProfit Referral Program with any other promotions offered by Solar Liberty in a cumulative manner if Solar Liberty determines in its sole and exclusive discretion that such combination is not permitted.
Compliance with Law. As a Referrer, you agree to comply with all applicable law, including, but not limited to the CAN SPAM Act. Any distribution of your SunProfit Referral Program link that could constitute unsolicited commercial email or “spam” under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your Account and exclusion from Solar Liberty’s SunProfit Referral Program.
Right to Terminate Accounts. Solar Liberty reserves the right to terminate the Account of any Referrer and/or Referred Customer at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any Referrer and/or Referred Customer’s conduct to be in violation of these Refer-A-Program Terms.
Right to Cancel Program or Change Terms. Solar Liberty reserves the right to cancel the SunProfit Referral Program and to revise these SunProfit Referral Program Terms from time to time. If we make any material changes to these SunProfit Referral Program Terms, we’ll notify you of those changes by posting them on the Services or by sending you an e-mail or other notification. If the SunProfit Referral Program is terminated, any unclaimed Referral Rewards may be forfeited at that time if not redeemed within one-year of termination of this program.
